One of my friends on XBOX Live has been playing Modern Warfare 2 since Monday November 2nd! How are hese people not being banned from XBOX Live?
Kind of ironic, but someone I work with was banned from Xbox LIVE the other day. His friend was as well for playing MW2 and other pirated games on LIVE. He said something about his friend not doing a stealth patch(?) on the game, so Microsoft found out and banned him.

They were playing multiplayer over Live too! I remember people getting banned for early releases of Halo 3.

Well, you have to realize people do play games over LIVE before their release (people who review games or work in the industry). I don't know a whole lot about it, but from what my friend at work said, if you do some sort of patch on a pirated game, then Microsoft will see the game as genuine. I guess it has something to do with your initial game save or something.
Does anyone here have a modded 360?
The guy playing is no one from the game industry playing MW2. I doubt he has it modded or patched as you suggest. I don't see how the servers allow regular Live users to play. I am jealous! If I have to wait until 11/10/09 then so should they!
Microsoft isn't going to know what gamertags are from reviewers and what not. I highly doubt Microsoft knows any of the GamePro employees tags. Certain people get early access to games. As long as the game seems to be legit, then the Live servers wont know the difference.
And do you know the guy personally? I know the guy with the modded Xbox personally and I never knew he pirated games until he told me ODST was a total rip off. I told him I wasn't going to pay for it and he said he didn't either, he just got a burnt copy. Look at the games he plays on LIVE, is he always playing the latest releases? My friend was, which explains the modded Xbox.

I have a an ex-gamepro edior on my friends list he's played games like NFS: Shift and Halo 3:ODST before their actual release date, he didn't banned or anything.
I don't really know the guy in real life but it sounded like he got it in some shady way.
Well, apparently there are some stores selling the game early (happens all the time, really). So, maybe he just knows a place that sold the game before the street date.
